Terms of service.

1. Acceptance of Terms

By accessing and using the website www.caterinamidwife.com and purchasing services offered by Caterina Battaini, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not use the Site or purchase my Services.

2. Nature of Services and Professional Scope

2.1 Midwifery and Consultant Services: I provide freelance midwifery services, including support during pregnancy, postpartum care, breastfeeding courses, birth preparation, and intimacy/sexual wellness consultations, both in-person in Sevilla and online (Spain-wide).
2.2 Professional Limitations (Non-Prescribing Clause): The Midwife is a licensed healthcare professional providing education, advice, and non-invasive support. The Midwife is not a medical doctor and is explicitly unable to prescribe medication or issue medical sick leave. All advice is complementary to, and not a replacement for, care provided by a medical doctor (Gynaecologist) or emergency services in the public or private health system.
2.3 Client Responsibility: Clients remain solely responsible for maintaining regular care with their primary healthcare providers (General Practitioner, Obstetrician, etc.) and seeking immediate emergency medical help when necessary.

3. Financial and Cancellation Policy

3.1 Payment Requirement: All consultations, packages, courses, and digital products must be paid in full at the time of booking through the Site’s integrated payment system (Squarespace Commerce/Stripe/PayPal).
3.2 Price Changes: Prices for Services and Courses are subject to change without notice. However, the price you pay at the time of booking is the final agreed price for that service or package.
3.3 Cancellation and Refund Policy (High-Touch Services: Consultations and Private Courses):

  • Cancellation More than 24 Hours in Advance: The client will receive a full refund of the fee paid.

  • Cancellation Less than 24 Hours in Advance: The client will be charged a 50% cancellation fee of the total service price to cover the professional's lost time. The remaining 50% will be refunded.

  • No-Show: If the client fails to attend a scheduled appointment without notification, the full fee is non-refundable.

    The only case in which the full price of the service will be refunded is for medical reasons that make it impossible to perform. I therefore ask you to notify me as soon as possible, depending on your state of health.

    3.4 Group Course Cancellation: Enrollment fees for group courses are generally non-refundable unless the course is cancelled by the Midwife. If a client must miss a session, no refund is available for the missed time.

4. Intellectual Property and Content Use

All materials provided during consultations or courses, including PDFs, handbooks, presentations, and website content (text, images, design), are the property of the Midwife. Clients may not copy, distribute, or resell these materials without prior written consent.

5. Photo and Clinical Case Consent

5.1 Photographic Consent: I may, from time to time, request permission to take photographs or video recordings of newborns, parents, or specific anatomical areas (e.g., breastfeeding latch/baby rash) for educational, supervisory, or marketing purposes. I require the explicit, written consent of both parents/legal guardians before any such image or video is taken or used.
 5.2 Clinical Case Anonymity: I adhere to the strictest standards of professional confidentiality. We will never share or discuss any specific clinical case or story in a public forum, blog, or social media, even in an anonymized form, without the explicit, written consent of the client.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, specifically the autonomous community of Andalusia and the courts of Sevilla.
